3. General Information on Data Processing
We process data as part of our business and website operations. This also includes disclosure by transmission to third parties and, if applicable, to so-called third countries outside the European Union (“EU”) and the European Economic Area (“EEA”). Insofar as we transfer data outside the EU or the EEA, we have marked this accordingly below.
4. Data Processing
The specific data affected, processing purposes, legal bases, recipients and, if applicable, transfers to third countries are listed below:
a) Log file when visiting the website
We log your website visit. In doing so, we process:
- Name(s) of our retrieved webpage(s),
- Date and time of retrieval,
- Amount of data transferred,
- Browser type and version,
- The operating system you use,
- The referrer URL (the previously visited website),
- Your IP address,
- The requesting provider.
The legal basis for data processing is our overriding legitimate interest in the continuous provision and security of our website in accordance with Art. 6 (1) (f) GDPR. The log file is deleted after seven days, unless it is required to prove or clarify specific legal violations that have become known within the retention period.
b) Hosting
To provide our online presence, we use services from web hosting providers who process the data mentioned above and all data to be processed in connection with the operation of this website (log file when visiting the website) on our behalf. The legal basis for data processing is our overriding legitimate interest in the provision of our website in accordance with 6 (1) (f) GDPR.
c) Contacting us
If you contact us, we process the following data from you for the purpose of processing and handling your inquiry: Name, contact details – if provided by you – and your message. The legal basis for data processing is our obligation to fulfill the contract and/or to fulfill our pre-contractual obligations in accordance with 6 (1) (b) GDPRand/or our overriding legitimate interest in processing your request in accordance with Art. 6 (1) (f) GDPR.
d) Services and administration of client relationships
We process various data as part of the provision of our services and for the initiation and execution of the existing client relationship between you and us. If you have granted us a mandate, we process your data (name, contact details, address) and all information necessary for the assertion and defense of your rights within the scope of the mandate exclusively for the purpose of processing and handling your mandate. This includes, in particular, appropriate legal advice and representation, correspondence with you, invoicing, fulfillment of our accounting and tax law obligations, but also the handling of any liability claims and the assertion of any claims against you. The processing of the data takes place on the basis of 6 (1) (b) GDPR as well as for the fulfillment of our legal obligations according to Art. 6 (1) (c) GDPR. Insofar as this is necessary for the processing of the client relationship, your data will be passed on to third parties. This includes, in particular, disclosure to opposing parties and their representatives, courts, public registers, and other public authorities for the purpose of correspondence as well as for the assertion and defense of your rights. We take all suitable measures to transmit only personal data limited to the extent necessary for the underlying purposes of data processing.
e) Contacting us regarding job applications
If you contact us to send us your application as an employee, e.g., by email or via a contact form, the data you provide (e.g., name, email address, desired location, etc.), your message, and the transmitted application documents will be processed exclusively for the purpose of processing and handling your application request. The primary legal basis for data processing is Section 26 of the German Federal Data Protection Act (BDSG). According to this, the processing of data required in connection with the decision on the establishment of an employment relationship is permissible. Should the data be necessary for legal prosecution after completion of the application process, data processing may take place to safeguard our legitimate interests according to 6 (1) (f) GDPR, namely for the assertion and/or defense of claims.
f) Use of cookies
We use so-called cookies on our website. Cookies are small text files that are stored on your respective end device (PC, smartphone, tablet, etc.) and saved by your browser. We only use technically necessary session cookies on our website.
g) External content
We use dynamic content (“content”) from third parties to optimize the presentation and the offering of our website. When you visit the website, a request is automatically made via an interface to the server of the respective content provider, during which certain log data (e.g., the IP address of the user) is transmitted. The dynamic content is then transmitted to our website and displayed there. We use external content in connection with the following functionalities:
aa) Google Maps
We use the “Google Maps” map service from Google on our website to provide you with an interactive map. When the map is displayed, data, including your IP address and your location, is transmitted to Google servers and stored there. This processing takes place on the basis of our overriding legitimate interest in the optimal marketing of our offer according to Art. 6 (1) (f) GDPR. The controller for data processing at Maps is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (hereinafter “Google”). It cannot be ruled out that data will be transferred to Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. There is no adequacy decision by the EU Commission for data transfers to the USA. Google ensures an adequate level of data protection via the EU standard contractual clauses. 5. Duration of Data Storage
We store personal data only as long as it is necessary for the purposes for which it is processed or until a consent granted by you has been revoked. Insofar as statutory retention obligations must be observed, the storage period for certain data can be up to 10 years, regardless of the processing purposes.
6. Your Data Subject Rights
a) Access
Upon request, you can receive information at any time and free of charge about all personal data we have stored about you.
b) Rectification, Erasure, Restriction of Processing (Blocking), Objection
Should you no longer agree with the storage of your personal data or should it have become incorrect, we will, upon corresponding instruction, arrange for the erasure or blocking of your data or make the necessary corrections (insofar as this is possible under applicable law). The same applies if we are only to process data in a restricted manner in the future. You have a right of objection in particular in cases where your data is required due to the performance of a task that is in the public interest or based on our legitimate interest, as well as profiling based on this. You also have such a right of objection in the case of data processing for the purpose of direct marketing.
c) Right of withdrawal for consents with effect for the future
You can revoke granted consents with effect for the future at any time. Your revocation does not affect the lawfulness of the processing up to the time of revocation.
d) Data Portability
If data processing is carried out on the basis of a contract, pre-contractual negotiations, consent, or by means of automated processes, you have the right to data portability. Upon request, we will provide you with your data in a common, structured, and machine-readable format so that you can transmit the data to another controller if you wish.
e) Restriction of Processing
Data where we are not able to identify the data subject, e.g., if it has been anonymized for analysis purposes, is not covered by the above rights. Access, erasure, blocking, correction, or transfer to another company may be possible with regard to this data if you provide us with additional information that allows us to identify you.
f) Exercise of your data subject rights and right of appeal
